These Terms of Service ("Terms") are a legal agreement between you ("you," "your," or "your company") and ProTechCam ("ProTechCam," "we," "us," or "our") governing your use of the ProTechCam mobile app, web dashboard, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
ProTechCam helps field‑service businesses document their work — capturing photos, voice notes, short videos, equipment details, GPS‑stamped work orders, customer signatures, time‑on‑site logs, and shareable reports. We may add, change, or remove features over time.
2. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your registration information, for keeping your login credentials secure, and for all activity under your account. The person who creates a company account is its owner and may invite, manage, and remove team members ("technicians"). The owner is responsible for their team's use of the Service.
3. Subscriptions, trials & billing
- ProTechCam may be offered as a paid subscription, with pricing and any free trial shown at sign‑up.
- If you purchase through the Apple App Store, payment, renewals, and cancellations are handled by Apple under your Apple ID, and Apple's terms apply. You can manage or cancel in your Apple ID settings; deleting the app does not cancel a subscription.
- If you purchase directly from ProTechCam (e.g., for company seats), fees are billed in advance through our payment processor, are non‑refundable except where required by law, and renew automatically until cancelled.
- We may change pricing on a going‑forward basis with reasonable notice.
4. Location & time‑on‑site tracking
The Service includes optional background location features ("Time on Site") that log when a technician arrives at and leaves a location, even when the app is closed, using your device's low‑power visit detection.
- These features only operate if the technician grants "Always" location permission, and can be turned off at any time in device settings.
- If you are a business owner enabling this for your team, you are responsible for notifying your technicians, obtaining any consent required by law, and using the data lawfully. ProTechCam provides the tool; you control how it is used.
- Location timing is approximate and provided "as is" — it is not a certified timekeeping or payroll system.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to capture, store, or share unlawful content.
- Upload content you lack the right to capture or share, or that infringes others' rights or privacy.
- Track any person without a lawful basis or required consent.
- Attempt to access another company's data, breach security, reverse‑engineer, scrape, or disrupt the Service.
- Resell or provide the Service to third parties except as your subscription permits.
6. Your content & customer data
You retain ownership of the records, photos, videos, notes, signatures, and other content you create ("Your Content"). You grant ProTechCam a limited license to host, process, transmit, and display Your Content solely to operate and improve the Service for you. When you document work for your own customers, you are the controller of that customer information and are responsible for complying with applicable privacy laws — including obtaining any consent needed to photograph or record people, capture signatures, log location, and share reports.
7. Photos, recordings & consent
You are solely responsible for ensuring you have permission to capture and store images, audio, video, and signatures of any person or property, and to share reports with customers or third parties.
8. Intellectual property
The Service — including its software, design, and branding — is owned by ProTechCam and protected by intellectual‑property laws. These Terms grant you only a limited, non‑exclusive, non‑transferable right to use the Service; they do not grant rights in our trademarks or technology.
9. Third‑party services
The Service relies on third‑party providers (cloud hosting, AI processing, mapping, and payment processing). Your use may be subject to their terms, and we are not responsible for their acts or omissions.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, error‑free, accurate, or that records or logs will never be lost. You are responsible for keeping your own backups of critical records.
11. Limitation of liability
To the maximum extent permitted by law, ProTechCam will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
12. Termination & account deletion
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate access if you violate these Terms or to protect the Service. On termination, your right to use the Service ends; provisions that by their nature should survive (ownership, disclaimers, limitation of liability) will survive.
13. Changes to these Terms
We may update these Terms from time to time. When changes are material, we will revise the "Last updated" date and provide additional notice where appropriate. Continued use after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Arkansas, USA, without regard to conflict‑of‑law rules, and you agree to the exclusive jurisdiction of the state and federal courts located there.
15. Apple App Store
If you downloaded the app from the Apple App Store, you acknowledge that these Terms are between you and ProTechCam only, not Apple, and that Apple is not responsible for the app or its content. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you. Your use must also comply with the Apple Media Services Terms and any usage rules in the App Store Terms of Service.
